Terms of Use

1. Description of the Service

Wakin is an alarm application that requires the user to complete a designated mission in order to turn off the alarm. The Service includes missions such as math, photo, QR code, physical movement and reading aloud; locked alarms; wake-up checks; a streak and badge system; and friend groups. Wakin reserves the right to add, modify or remove features of the Service without prior notice.

2. Licence

Subject to your compliance with these Terms, Wakin grants you a limited, non-exclusive, non-transferable and revocable licence to use the Service for personal, non-commercial purposes only. You must be at least 13 years old to use the Service; if you are under 18, you must have the consent of a parent or legal guardian.

3. Subscription, fees and payment

• The Service is offered as a paid subscription that begins with a free trial period. Subscriptions not cancelled before the end of the trial are charged automatically according to the selected plan and renew at the end of each period.
• Payment, cancellation and refunds are handled exclusively by the Apple App Store or Google Play (the “Store”) and are subject to the Store’s terms. You may cancel the subscription at any time in the subscription settings of your Store account; cancellation takes effect at the end of the current period. No refunds are issued for unused periods; refund requests are assessed under the Store’s policies.
• Fees are those displayed in the Store, in the currency shown there. Fee changes are communicated in advance through the Store and apply from the next renewal period.

4. Important notice regarding alarm reliability

Whether an alarm rings depends on factors outside Wakin’s control, including the operating system, battery management, notification and sound settings, Do Not Disturb mode, the device being switched on and charged, and the permissions granted to the application. The alarm may not ring if the device is off, the battery is depleted, the application has been terminated by the system or permissions have been revoked.

Wakin does not guarantee that alarms will ring under all circumstances or on time. For situations in which missing an alarm could have significant consequences (flights, examinations, job interviews, medical appointments and the like), you are advised to use an independent backup alarm. Wakin is not liable for any direct or indirect loss resulting from a missed or delayed alarm.

5. Locked alarm

The locked alarm is an optional feature enabled by the User. When enabled, the alarm locks at bedtime and cannot be disabled from the settings until the morning mission has been completed. In an emergency, the lock can be released through the “emergency exit” option, in which case the User’s streak is reset. By enabling the feature you accept this behaviour.

6. Health and safety

Physical missions such as push-ups, squats, steps and shaking are performed entirely at the User’s own risk. If you have a medical condition for which physical activity may be inadvisable, you should not select these missions; alternatives such as math, typing and memory missions are always available. Camera missions should be performed in a safe environment with awareness of your surroundings. Wakin does not provide medical advice.

7. Friend groups

• Content entered by Users, such as group names, icons and stake text, must not be offensive, harassing, discriminatory or unlawful.
• The stake is a symbolic agreement among members. Wakin is not a party to that agreement, does not act as an intermediary for money or prizes, and does not enforce or supervise the settlement of debts.
• Sharing invite codes is the User’s responsibility. Anyone who obtains a code may join the group and view the members’ wake-up status.
• Wakin reserves the right to remove a group or an anonymous profile without prior notice in the event of use contrary to these Terms.

8. User obligations

When using the Service, the User agrees not to:

• Reverse engineer, decompile or otherwise attempt to derive the source code of the Service.
• Circumvent mission verification mechanisms through automated tools or manipulation.
• Overload the servers, attempt to bypass security measures or gain unauthorised access to other users’ data.
• Use the Service for any unlawful purpose.

9. Intellectual property

All elements of the Service, including the Wakin name and logo, the mascot, the interface design, texts, images and software, are owned by Wakin and protected by intellectual property law. These Terms transfer no rights to the User other than the licence defined in Section 2. Custom sounds added by the User remain the User’s property and never leave the device.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Wakin makes no express or implied warranty that the Service will be uninterrupted, error-free or fit for a particular purpose.

11. Limitation of liability

To the maximum extent permitted by applicable law, Wakin is not liable for loss of profit, loss of data or any indirect, incidental, special or punitive damages arising from the use of, or inability to use, the Service. Wakin’s total liability under these Terms shall in any event be limited to the amount paid by the User for the Service in the twelve months preceding the claim. Rights arising from consumer protection law that cannot be limited by contract remain unaffected.

12. Term and termination

These Terms remain in effect for as long as you use the Service. The User may terminate the agreement at any time by uninstalling the application and cancelling the subscription through the Store. Wakin reserves the right to suspend or terminate the User’s access to the Service in the event of a breach of these Terms. Termination does not affect provisions that by their nature are intended to survive.

13. Changes to the Terms

Wakin may update these Terms. The current version is published on this page together with its effective date; material changes are additionally announced within the application. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes arising from these Terms. Users who qualify as consumers retain the right to apply to the consumer arbitration committees and consumer courts of their place of residence, and nothing in these Terms limits mandatory consumer rights under the law of the country in which you reside.
